1. Who we are

This website is operated by GetSweaty Pty Ltd (GetSweaty, we, us). By accessing or using getsweaty.com.au you agree to these terms. If you do not agree, please do not use the site.

2. What this website is

This site is marketing and information material about the GetSweaty platform. It describes a micro-equity marketplace connecting founders with senior operators and investors. It is not the platform itself, and it does not create any account, engagement, option grant or equity arrangement.

Creating an account on the product is governed by the platform terms presented to you at sign-up. Any engagement between a founder and an expert is governed by the specific agreement — typically an option agreement — generated and signed for that engagement. Where those documents conflict with anything on this website, those documents prevail.

3. No advice

Nothing on this website is financial, investment, legal, tax or accounting advice, and nothing here is an offer, invitation or recommendation to acquire, dispose of or deal in any security or financial product. Equity and options in an early-stage private company are illiquid and can become worthless.

You should obtain your own independent professional advice before offering equity, accepting an option grant, or making any investment decision. Read the equity disclaimer for the full position.

4. Illustrative content

Company names, roles, percentages, milestones and deal-flow examples shown on this website are illustrative. They are not live listings, not offers, and not representations about any actual company or engagement.

5. Acceptable use

You agree not to:

• use the site in a way that breaches any applicable law or regulation;
• attempt to gain unauthorised access to the site, its servers, or any connected system;
• interfere with the availability or integrity of the site, including by introducing malicious code or placing unreasonable load on it;
• scrape, mirror or systematically extract content for the purpose of building a competing service; or
• use our name, marks or content in a way that suggests endorsement or affiliation that does not exist.

The site may link to third-party websites and services. We do not control them, we do not endorse them by linking to them, and we are not responsible for their content, terms or privacy practices.

8. Availability

We aim to keep the site available, but we do not guarantee uninterrupted or error-free access. We may change, suspend or withdraw all or part of the site at any time without notice.

To the maximum extent permitted by law, we exclude all warranties, representations and conditions not expressly set out in these terms, and we are not liable for any indirect, incidental, special or consequential loss, or any loss of profit, revenue, opportunity, goodwill or data, arising from your use of this website.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law or comparable consumer protection legislation where you are. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant information or paying the cost of having it resupplied.

We may update these terms from time to time. The version published here is the version that applies, and the date at the top of this page shows when it last changed. Continuing to use the site after a change means you accept the updated terms.

11. Governing law

GetSweaty Pty Ltd is an Australian company, so these terms are governed by the laws of Australia and you and we submit to the non-exclusive jurisdiction of the Australian courts. We make the site available worldwide; if you access it from outside Australia, you are responsible for compliance with the laws that apply where you are.
